News Letter #11 - December, 2002

Hello from Tony,

It's December already! Where has the time gone? They say, "The older you get the faster time seems to go by". Now that I'm "up in my years" is seems this is so true. Why is that? Is it because as a child, time didn't seem important to me as I always thought there was plenty of it left and now that I've grown older I know now how precious time left can be? I have become more aware of everything around me and of all the beauty of the world and its people, especially loved ones. I have lost grandparents, parents, sibling and friends which I will especially remember over this holiday season. I will love the ones with me now and remember loved ones lost. Tina and I hope your Holidays are happy and safe ones.

INTERESTING "ART-I-FACT" OF THE MONTH:

Copyright protection for your artwork.

Copyright is not a symbol or date that you put on a piece of work, but the act of defending your ownership of a work that you have created from an original idea or thought. The key thing is to be prepared and protected against infringement.

Your artwork is under copyright protection the moment it is created and fixed in a tangible form so it can be visibly seen either directly or with the aid of a machine or device. Example, as soon as you draw or paint a picture on paper or canvas, your artwork receives copyright protection. For artwork created after January 1, 1978, copyright protection will endure for the life of the artist plus an additional 70 years. Now that's a long time!

There are ways to help defend your rights to a piece created by you to support your position in any copyright arguments that may arise. To be safe, keep a record of all your paintings as you do them. Include the dates and any reference material, photos, sketches, etc., from which the work was derived and a photo of the work itself. The better your records are of creating the work the better your chances are of defending it as your own.

Although registering a copyright can be done, it's an expensive process that is not necessary in most cases. Placing the copyright notifer or this symbol "©" after the artists name informs the world of your rights to the artwork. Artists retain the copyright to their art works with or without the copyright symbol and/or registration unless contractual agreements are made otherwise. Having a date on your painting also adds to it's time of origin.
